Every now and then I get a call from an investor asking me how to buy a foreclosure on the "courthouse steps". If you are interested in doing this there are a few things you need to know.
1 - The properties are auctioned in the lob of the Clerk's office which is currently on the 6th floor of the Collier County Judicial building at 11am.
2 - The successful bidder is required to submit a non-refundable deposit of 5% of the purchase price at the time of purchase. This can either be in cash, cashier's check or a money order.
3 - The total remaining balance must be submitted to the Clerk of Courts by 10:30am the day after the sale. You will also be charged a registry fee of 3% for the first $500 and 1.5% for every $100 after that for the entire purchase amount. As with the deposit the final payment must be cash, cashier's check or a money order.
4 - The Clerk's office will not assist you in researching the property, but you are allowed to view their files if you request to. This is important to see if there are any liens or pending bankruptcies.
5 - Be aware that sometimes the property may be occupied. If this is the case you will have to take legal action to remove the occupant.
6 - You will be billed for a certified copy of the Certificate of Title and Documentary Stamps which must be paid prior to issuing a title.
7 - If you find the property has any back taxes make sure you pay them off quickly to avoid a tax deed sale form occurring.
8 - Make sure to complete a Department of Revenue (DR-219) from and send with the certificate of title at the time of closing.
